Affiliate Terms

Introduction

Welcome to the Gumawa Affiliate Program (“Program”). By joining, you agree to these Terms and Conditions (“Terms”). Please read them carefully before participating. Gumawa (“we,” “us,” “our”) reserves the right to modify these Terms at any time.

Eligibility

To participate, you must be at least 18 years old and able to enter into a binding agreement. Affiliates should have a genuine interest in promoting our premium hospitality web design and digital services.

Enrollment

Affiliate enrollment is subject to approval by Gumawa. We reserve the right to accept or reject applications at our sole discretion.

Affiliate Responsibilities

You agree to promote Gumawa’s services ethically and professionally, in accordance with all applicable laws and regulations. Misleading, deceptive, or unethical promotion is strictly prohibited.

Commissions

• Affiliates earn a commission of 5% recurring on all payments received from clients they referred, plus 5% of the setup fee.
• Commissions are calculated on the net revenue received by Gumawa, excluding taxes, refunds, chargebacks, and any discounts.
• Commissions are paid monthly, at the end of the month following the client’s payment.
• Commissions are only paid for active clients whose accounts are in good standing.

Payment Terms

• Affiliates must provide accurate payment details for commission disbursements.
• Payments will be made via bank transfer or PayPal.
• Gumawa reserves the right to withhold payments if fraudulent activity is suspected.

Affiliate Tracking

• Referral tracking is managed through our affiliate system, which records clicks, leads, and conversions.
• Affiliates are responsible for ensuring their referral links are used correctly.
• Gumawa is not responsible for lost commissions due to incorrect link usage or technical issues outside our control.

Termination

• Either party may terminate this Agreement at any time, with or without cause, by giving written notice.
• Upon termination, unpaid commissions for referrals made before termination will be paid according to these Terms.

Intellectual Property

• Gumawa grants affiliates a non-exclusive, non-transferable license to use our trademarks and marketing materials solely to promote our services.
• Affiliates must comply with brand guidelines and not alter any trademarks or materials.

Prohibited Activities

Affiliates must not:

• Use spam or unsolicited communications to promote Gumawa.
• Engage in misleading advertising or false claims.
• Bid on Gumawa trademarks or related keywords in paid search campaigns without permission.
• Engage in any activity that could harm Gumawa’s reputation or violate laws.

Limitation of Liability

Gumawa is not liable for any indirect, incidental, or consequential damages arising from participation in this Program.

Governing Law

These Terms are governed by the laws of The Philippines.

Changes to Terms

Gumawa reserves the right to modify or terminate the Program or these Terms at any time, with or without notice.
